Privacy Policy

1. Who We Are

SpakySEND is a package delivery platform operated by Spaky Enterprise, owned by Michael Hagan, based in Ghana. We connect senders with verified delivery riders across Ghana.

2. Information We Collect

We collect information you provide directly to us when you create an account or use our platform:

  • Full name and email address
  • Phone number (used for SMS verification and delivery notifications)
  • Mobile Money (MoMo) number (for wallet withdrawals)
  • Delivery and pickup addresses
  • Package details and delivery instructions
  • Payment transaction records via Paystack

For riders, we additionally collect:

  • Government-issued ID card (for identity verification)
  • Video selfie (for identity verification during application)
  • Real-time location while the rider is online and on active deliveries
  • Bank account or MoMo details for payouts

3. How We Use Your Information

  • To create and manage your account
  • To verify your identity via SMS OTP on every login
  • To match senders with available riders
  • To send real-time delivery status updates via SMS and push notifications
  • To process wallet top-ups and withdrawals via Paystack
  • To display live rider location to the sender during an active delivery
  • To review rider applications and approve or reject them
  • To investigate disputes, cancellations, and platform abuse
  • To communicate important service updates

4. Location Data

Riders share their real-time location while they are online. This location is used to:

  • Match nearby riders to pending orders
  • Display live rider movement to the sender during delivery
  • Calculate accurate delivery distances and fees
Rider location is only active when the rider is logged in and marked as online. Riders can go offline at any time from their dashboard, which stops location sharing.

Senders' pickup and delivery addresses are stored to fulfil orders and are not shared with third parties beyond what is necessary to complete the delivery.

5. Sharing Your Information

We do not sell your personal data. We share information only as necessary to operate the platform:

  • Paystack — for processing payments. Paystack has its own privacy policy at paystack.com/privacy
  • Sendexa — for delivering SMS OTP and delivery notifications
  • Brevo — for sending transactional emails
  • Cloudinary — for storing rider ID card and video selfie uploads
  • Google — for Maps, Places, and optional Google Sign-In

We may disclose your information if required by Ghanaian law or a valid legal process.

6. Data Retention

We retain your account data for as long as your account is active. If you request deletion of your account, we will remove your personal data within 30 days, except where retention is required by law or for legitimate business purposes such as resolving disputes or preventing fraud.

Rider identity documents (ID card and video) are retained for the duration of their active status on the platform and deleted within 60 days of account termination.

7. Your Rights

Under the Ghana Data Protection Act 2012, you have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data
  • Withdraw consent for data processing where consent is the basis
  • Lodge a complaint with the Data Protection Commission of Ghana

8. Security

We implement industry-standard security measures including encrypted connections (HTTPS), hashed passwords, and JWT-based authentication with short-lived access tokens. However, no system is completely secure and we cannot guarantee absolute security of your data.

9. Children

SpakySEND is not intended for use by anyone under the age of 18. We do not knowingly collect personal data from minors. If you believe a minor has created an account, contact us immediately and we will delete it.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of SpakySEND after changes are posted constitutes acceptance of the updated policy.
