Terms of Service

1. Acceptance of Terms

By creating an account or using SpakySEND, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users — senders and riders.

SpakySEND is operated by Spaky Enterprise, owned by Michael Hagan, based in Ghana.

2. Eligibility

• You must be at least 18 years old to use SpakySEND
• You must provide accurate and truthful information during registration
• You must have a valid Ghanaian phone number capable of receiving SMS
• Riders must be physically located in Ghana and legally permitted to work

3. Sender Responsibilities

• You are responsible for providing accurate pickup and delivery addresses
• You must not submit orders for illegal, hazardous, or prohibited items
• You must ensure sufficient wallet balance before placing an order
• You must be available or have a representative available at the pickup address when the rider arrives
• You are responsible for the contents of all packages you submit for delivery

4. Rider Responsibilities

• Riders must complete the application process truthfully and submit genuine identity documents
• Riders must only accept orders they intend to complete
• Riders are responsible for handling packages with care
• Riders must confirm pickup and delivery accurately through the dashboard
• Excessive cancellations will result in automatic suspension from the platform
• Riders must comply with all applicable Ghanaian road and traffic laws

5. Payments and Wallet

• Senders must top up their wallet via Paystack before placing orders
• The delivery fee is deducted from the sender's wallet when an order is submitted
• If no rider accepts an order and it expires, the full fee is refunded to the sender's wallet instantly
• Rider payouts are processed manually via Paystack during our current operating phase
• Sender wallet withdrawals are processed manually to the MoMo number on file
• SpakySEND retains 25% of each delivery fee as a platform commission
• All fees are displayed before order submission and are non-negotiable once an order is accepted by a rider

6. Cancellations and Refunds

• Senders may cancel an order at any time before a rider is assigned — full wallet refund is issued instantly
• Cancellations after a rider has been assigned are subject to review
• Riders who cancel an accepted order will have their cancellation count incremented
• Riders who exceed the cancellation threshold will be automatically suspended
• SpakySEND reserves the right to adjust refund decisions in cases of demonstrated fraud or abuse

7. Prohibited Use

You may not use SpakySEND to:

• Transport illegal goods, controlled substances, weapons, or hazardous materials
• Provide false information during registration or order submission
• Abuse, threaten, or harass riders, senders, or SpakySEND staff
• Attempt to manipulate pricing, fees, or the order assignment system
• Create multiple accounts to circumvent suspensions or bans
• Use the platform for any purpose other than legitimate package delivery

Violations may result in immediate account suspension or permanent ban without refund.

8. Liability

SpakySEND acts as a technology platform connecting senders with independent riders. We are not a logistics company and do not employ riders directly.

• SpakySEND is not liable for loss, theft, or damage to packages during delivery
• SpakySEND is not liable for delays caused by traffic, weather, or circumstances beyond a rider's control
• SpakySEND is not liable for incorrect delivery addresses provided by senders
• Our total liability to any user in any circumstance shall not exceed the value of the delivery fee paid for the affected order

9. Account Suspension and Termination

SpakySEND reserves the right to suspend or terminate any account at any time for violation of these terms, fraudulent activity, or behaviour that harms the platform or other users. Suspended users will be notified by email with a reason where possible.

10. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of SpakySEND after changes are posted constitutes acceptance of the updated terms.

11. Governing Law

These Terms of Service are governed by the laws of the Republic of Ghana. Any disputes shall be resolved under Ghanaian jurisdiction.
